Scope and service provider

These terms govern the Vesper Optic iPhone app and official website (the "Service") provided by Jihoon Lee ("Vesper," "we," or "us") from the Republic of Korea. By downloading, purchasing or using the Service, you agree to these terms to the extent permitted by the law where you live.

Apple's Standard End User License Agreement also applies to an App Store download. Mandatory law comes first, followed by Apple's terms for the App Store transaction and these terms for our Service. These terms never remove a non-waivable consumer right.

The website does not directly accept orders or payment. Verified address, telephone and registration details will be displayed through the App Store or a linked disclosure before paid distribution in a jurisdiction that requires them.

Eligibility and minors

You must be legally able to enter this agreement or use the Service with permission from a parent or guardian. Purchases are subject to the Apple account holder's authority, Apple Family settings and local rules for contracts with minors.

The global launch-notice form is limited to people aged 18 or older. The app itself is a general-audience camera, does not create a Vesper account and does not send your creative content to us.

What Vesper Optic provides

Vesper Optic lets you select a Look before capture, apply colour to still photos and videos, preserve originals and edit scenes on a compatible iPhone. Some features require supported hardware, a supported iOS version, available storage and camera, microphone, Photos or location permission.

Optional permissions affect only the related feature. Capture formats, frame rates, lenses and performance vary by device and operating-system capability.

The first 36 still photos

The free first roll applies to still photos only.

You can take the first 36 still photos with all launch Looks. Video capture requires paid access from the beginning.

  • After the 36th still photo, a valid paid entitlement is required for new photo or video capture.
  • Your existing scenes remain available for library viewing, editing, all Looks, metadata review and sharing.
  • Reinstalling the app, changing devices or changing Apple account state does not guarantee that the free count will reset or restore.
  • We may restrict deliberate attempts to bypass the free count or transaction verification.

All three options unlock the same capture capabilities and differ only in billing and duration. A one-time purchase is a non-consumable licence for the current app, not a promise covering the purchaser's lifetime, every future product or unlimited platform support. If we can no longer provide its essential function for reasons within our control, mandatory refund and remedy rights still apply.

The App Store purchase sheet controls the exact price, currency, tax treatment, billing period, promotion and any trial. A trial exists only when that sheet expressly displays it.

Contract, payment and restoration

A paid contract is formed when you review the App Store product and price, complete Apple's authentication and Apple confirms the transaction. Apple handles the payment method, billing, tax calculation, receipt and App Store transaction record.

Vesper uses StoreKit transaction information to verify entitlement and does not receive your Apple password or full card number. You can use Restore Purchases with the same Apple account. If restoration fails, verify the Apple account and purchase history before contacting us.

Automatic renewal and subscription cancellation

A monthly or annual subscription may automatically renew for the same period at the price shown by the App Store unless it is cancelled before renewal. Apple provides notice or consent for price changes as required by its rules and local law.

  • Manage or cancel a subscription in iOS Settings or Apple's subscription management.
  • Deleting the app or changing devices does not cancel a subscription.
  • After cancellation, access normally continues until the end of the already-paid period unless a refund or local law provides otherwise.
  • A free or discounted trial may convert to a paid subscription unless cancelled by the deadline displayed by the App Store.

Withdrawal, cancellation and refunds

App Store payment and refund requests are submitted through Apple's refund process. Apple's process does not replace a mandatory right you have against Vesper under the law where you live.

Contact us if there is a duplicate or unauthorised transaction, an essential paid feature is not delivered, or the Service materially differs from its description. Where required, we will work with Apple to provide correction, continued performance, a price reduction, cancellation, refund or compensation.

Digital-content withdrawal rules differ by country. If a right may be lost when immediate digital performance begins, that restriction applies only after the notice, express request or consent and confirmation required by local law. Sections below state important regional differences.

Your photos, videos and data

You or the relevant rights holder retain ownership of content you capture, import, edit and store. Vesper does not upload that content to its own server, use it in advertising or take a licence beyond the on-device processing required to provide the features you choose.

You are responsible for respecting copyright, image rights, privacy and rules at locations where recording is restricted. Keep a separate copy of important originals. Deleting a scene or app data may be irreversible, while copies saved separately in Apple Photos may remain.

App licence and intellectual property

Vesper or its licensors own the app software, Look designs, name, marks, graphics, documents and interface. Subject to these terms and your paid entitlement, we give you a limited, personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control as permitted by Apple's rules.

No ownership of the app or its intellectual property is sold. Open-source components remain subject to their own licences.

Acceptable use

You must not:

  • use the Service for unlawful recording, rights infringement or criminal activity;
  • bypass or manipulate the free count, transaction verification, access controls or security;
  • copy, rent, resell, reverse engineer or redistribute the app beyond what mandatory law permits;
  • introduce malicious code, automated attacks or abnormal requests that damage the Service or related systems; or
  • misrepresent your identity or Vesper's origin, endorsement or affiliation.

Service changes, interruption and closure

We may improve or change the Service for quality, compatibility, security, law, App Store policy or necessary operations. We will give reasonable advance notice of a material reduction to paid functionality or service closure. If urgent security, platform failure or force majeure makes advance notice impracticable, we will notify users as soon as reasonably possible.

If a failure within our control prevents material paid use, we will provide the correction, extension, refund or other remedy required by law. We may proportionately restrict a serious legal or contractual violation after notice, except where immediate action is needed to prevent harm. You may contact us to challenge a restriction.

Responsibility and statutory guarantees

We will provide the Service with reasonable care and skill and address verified defects within a reasonable scope. We are responsible for loss caused by our intent or negligence to the extent required by law.

We are not responsible for a failure caused solely by unsupported hardware, insufficient storage, denied permissions, user misuse, an Apple or network outage, or an event beyond reasonable control where we did not contribute to the loss. A Look's appearance varies with light, subject, display and settings, so no particular aesthetic outcome is guaranteed.

Nothing in these terms excludes or improperly limits liability for intentional or grossly negligent conduct, death or personal injury, fraud, or any consumer guarantee or remedy that cannot legally be excluded.

Regional consumer terms

The following terms apply when the Service is officially offered in the stated region. They override inconsistent language above only to the extent local mandatory law requires.

European Economic Area and United Kingdom

Consumers generally have a 14-day withdrawal right for distance contracts. For digital content or a digital service, that right may end or be adjusted only after the legally required request for immediate performance, acknowledgement and confirmation. You retain legal conformity remedies for digital content and services. Local consumer law and the courts available at your habitual residence are not displaced. EU trader contact details will be verified and displayed by Apple before EU distribution.

United States

Federal and state consumer, automatic-renewal and privacy laws remain applicable. These terms contain no mandatory arbitration clause, class-action waiver or jury-trial waiver. If a state gives you stronger cancellation, renewal notice, warranty or remedy rights, those rights control.

Canada and Québec

Federal and applicable provincial consumer and privacy laws remain in force. Québec consumers must receive the French version and related documents before agreeing where Québec language law requires it; the Québec storefront must not be specifically targeted until that version is available.

Australia

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major service failure, an Australian consumer may cancel and obtain a refund for the unused portion or compensation for reduced value, and may recover other reasonably foreseeable loss or damage. For a non-major failure, Vesper must rectify it within a reasonable time or the consumer may exercise the remedies provided by law. These rights apply in addition to Apple's refund process.

New Zealand

The Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply where they cannot be contracted out. You retain rights to correction, cancellation, refund or damages for a qualifying failure or misleading representation.

Japan

The Consumer Contract Act and Act on Specified Commercial Transactions apply where relevant. Seller name, address, telephone, price, payment timing, service timing, subscription renewal and cancellation information must be presented in Japanese through the storefront or a linked commercial disclosure before Japan distribution.

Taiwan

Taiwan's Consumer Protection Act remains applicable. These terms do not waive statutory cooling-off, digital-content, unfair-term or remedy rights where the law provides them. Traditional Chinese legal information must be made available before a targeted Taiwan launch.

Hong Kong

Hong Kong consumer protections remain applicable. These terms do not waive any non-excludable right or remedy, and Traditional Chinese legal information will be provided if Vesper specifically targets Chinese-language consumers in Hong Kong.

Singapore

The Consumer Protection (Fair Trading) Act and other non-waivable Singapore rights remain applicable. Subscription pricing, renewal and cancellation must remain clear and must not use a subscription trap or misleading omission.

Mainland China

Vesper is not currently offered in mainland China. Mainland distribution remains disabled until Apple and government app-filing requirements, local-language terms, operator information, privacy arrangements and any required permits are complete.

India

India's mandatory consumer rights apply when the Service is officially offered. The Digital Personal Data Protection Act and 2025 Rules have staged commencement dates; the India launch and child-consent flow will be reviewed against the provisions in force at the launch date.

Brazil and Mexico

Brazilian and Mexican consumer rights, privacy and e-commerce disclosures remain applicable. Brazil requires Portuguese legal information and valid LGPD international-transfer arrangements; Mexico requires a Spanish integral privacy notice with the controller's full address. These storefronts should remain restricted until those items are complete.

Other countries and regions

Your mandatory local consumer rights remain unaffected. We may restrict storefront availability where a local registration, representative, language, tax, permit or data-transfer requirement has not been completed.

These terms are governed by the laws of the Republic of Korea, without depriving a consumer of mandatory protection in the country where they habitually live. A dispute may be brought before a court that has jurisdiction under applicable law; these terms do not force an unfair exclusive venue.

We may amend these terms for law, security or Service changes. We will normally give at least 7 days' notice, and at least 30 days for a material adverse change. A change will not retroactively reduce an existing paid right. If law requires separate consent, we will request it.
